All purchasers must complete registration with full legal name, current street address, phone number, and email. Please ensure all information is accurate at registration; delays or lost notices can occur if contact details are incorrect. We may refuse, suspend, or cancel a bidding account at our discretion.
To register, click “Submit Bid” on any lot and follow the prompts—it takes about two minutes. If you need assistance, email info@brandusedworks.com. Unless stated otherwise, all items open at $10 with no reserve.
A buyer’s premium is added to the hammer price on each lot. When you bid directly with Brand Used Works, the premium is 12% if you pay by cash, cashier’s check, money order, ACH, or bank check, and 15% if you pay by credit card. When you bid through third-party platforms (such as Proxibid, HiBid, LiveAuctioneers, BidSpirit, or EstateSales.net), the premium is 15% for cash or certified funds and 18% with credit card. The premium is calculated per lot and appears on your invoice.
A preliminary invoice is emailed from info@brandusedworks.com after the auction concludes. Review it carefully. Shipping and transfer fees are added once your order is packed and weighed; we then email a final invoice reflecting total charges. We do not automatically charge the card on file without the final shipping amount.
We accept Visa, MasterCard, American Express, Discover, cash, cashier’s check, money order, bank check, and approved ACH or wire. If you wish to avoid the 2.99% credit card fee, you may mail a check or money order; the envelope must be postmarked within three (3) days of the auction and include a clear copy of your driver’s license/ID. Do not wait for the final invoice to mail your check—use your preliminary totals; any overage is credited to your order. Shipping must be paid by credit card once the final amount is known. Checks are accepted from the registered bidder only and must clear before items ship. Chargebacks, NSF checks, or fraudulent payments on firearms are referred to law enforcement and the ATF. Our licensed premises are in Henderson, Texas and all in-person transfers and payments occur there.
You are solely responsible for knowing and complying with all local, state, and federal laws regarding possession, transfer, and shipment of firearms, ammunition, and related items. You must be 18 to purchase a rifle or shotgun, 21 to purchase a handgun, 18 to purchase long-gun ammunition, and 21 to purchase handgun ammunition. If you purchase an item that cannot ship to your location, we will consign it in a future sale on your behalf and mail a check for the net proceeds, less commission and costs.
Once registered, you may bid as soon as a catalog is open. All bids are final and create a binding contract. To avoid disappointment, bid early—there is no advantage to last-second “sniping” in a live webcast environment and late clicks can be missed due to local device or network delays. You are responsible for monitoring your lots and ensuring you are the high bidder at close; spam filters, device settings, or connectivity issues are outside our control. Brand Used Works employees may bid as collectors; consignors are prohibited from bidding on their own items.
Because our sales run across multiple platforms, identical high bids can arrive at the same moment. The authoritative high bid is the one first recorded on our auctioneer console. If time stamps are indistinguishable, we award the lot by a neutral rotation that does not favor any platform. We may resume, restart, or extend any auction interrupted by technical issues.
Read each description and review all photos carefully. Condition statements reflect our opinion only and are not a warranty. Most items are estate consignments; we do not test fire, disassemble, or guarantee function or completeness of internal parts. All items are sold as-is, where-is, without warranty, and all sales are final. There is no inspection period after purchase. If you visit our facility, you are encouraged to inspect items in person prior to bidding. When in doubt, do not bid.
Texas sales tax applies to lots picked up at our Henderson, TX location or shipped to a Texas address. Tax is typically calculated on the hammer price plus buyer’s premium; shipping and insurance may also be taxable under Texas rules. Shipments to addresses outside Texas are not charged Texas sales tax. If you are tax-exempt (resale or qualifying agency), email a valid certificate before we finalize your invoice.
Local pickup is by appointment at 608 Pinehill Rd, Henderson, TX 75654. Use the scheduler on our website to select a time once your invoice is paid. Items must be paid and picked up within one week of the sale unless other arrangements are made. A late and storage fee of $5 per day begins after 14 days. Items remaining 60 days after the sale are deemed abandoned and may be resold; proceeds are applied to storage and charges.
We pack in-house and primarily ship via UPS (and, when appropriate, USPS). Handguns ship UPS Next Day Air; long guns ship UPS Ground. Ammunition, powder, and primers ship Ground and cannot be packed with a firearm. We combine shipments when lawful and practical to reduce cost. Shipping charges, including required insurance and any box or packing fees, are added to your final invoice. You will receive tracking upon label creation. We do not ship internationally.
We strictly observe all federal and state firearm laws and hold a Federal Firearms License in Texas. The person who registered and won the lot must be the person who pays and takes possession. For Texas residents picking up locally, transfer requires ATF Form 4473 and a successful background check; if delayed, pickup occurs upon proceed. For out-of-state buyers, firearms ship to the licensed FFL of your choice after payment clears and we receive their signed license by email at transfers@brandusedworks.com; ask your dealer to include your full name and invoice or auction number. We verify FFLs prior to shipment. We accept C&R licenses for eligible firearms; C&R holders must also email a copy of their driver’s license. We do not send our FFL to non-licensees.
If you are denied after NICS, the firearm will not be transferred; it will be consigned in a future sale and the net proceeds after commission and costs will be mailed to you.
By bidding and purchasing, you accept all risks associated with possession, storage, transport, and use of firearms and ammunition. We recommend that every firearm be inspected by a qualified gunsmith prior to firing. Brand Used Works Auction House LLC, the seller, and affiliates disclaim liability for accidents, injuries, or damages arising from use or misuse.
If you do not see preliminary or final invoices in your inbox within the stated time frames, check spam or contact info@brandusedworks.com. Your posted wins on www.brandusedworks.com (and www.buwguns.com, if applicable) are final. For questions during the sale, email info@brandusedworks.com or call 903-392-0069.
Two-day auctions typically present Lots 1–700 on Saturday and Lots 1000–1700 on Sunday. All bids are per the catalog number and lots sell in numerical order. We may withdraw, re-catalog, or refuse service to any bidder for any reason deemed necessary by Brand Used Works. The placing of a bid constitutes full agreement to these Terms & Conditions and creates a binding contract under Texas law.
There are No Refunds on Firearms, Auction Items are as is, where is and all sales are final. Please refer to pictures for condition prior to bidding, and please reach out to us in a timely manner prior to the auction with individual questions pertaining to functionality of a specific item. Firearms are a touchy item in many ways including manufacture defects, ammo type, user error, etc. If you are unsatisfied with your purchase we are willing to re-consign your firearm in an upcoming auction at a discounted rate.
